Please read these Terms & Conditions carefully before placing an order with Kingsfold Nursery. By using our website or purchasing from us, you agree to be bound by these terms. If you do not agree, please do not use our site.

1. About Us

Kingsfold Nursery is a trading name of The Garden Works Ltd, a company registered in England and Wales. References to "we", "us" and "our" refer to Kingsfold Nursery / The Garden Works Ltd. References to "you" refer to the customer using our website or purchasing our products.

2. Placing an Order

When you place an order on our website, you are making an offer to purchase the selected products. We reserve the right to accept or decline any order. A contract is formed when we send you an order confirmation email.

• You must provide accurate and complete contact, delivery, and payment details
• We reserve the right to cancel orders if stock becomes unavailable or if we suspect fraudulent activity
• Order confirmations are sent by email — please check your spam folder if you do not receive one

3. Pricing & Payment

All prices are displayed in pounds sterling (GBP) and include VAT where applicable. We reserve the right to change prices at any time without notice, but the price applicable to your order is confirmed at the time of checkout.

• Payment is taken in full at the time of ordering
• We accept major credit and debit cards and other payment methods shown at checkout
• If a pricing error occurs, we will contact you before processing your order

4. Delivery

We aim to dispatch orders within the timeframe stated at checkout. Delivery times are estimates and cannot be guaranteed. Kingsfold Nursery (The Garden Works Ltd) is not responsible for delays caused by couriers, extreme weather, or other circumstances beyond our control.

• Delivery is available to mainland UK addresses only unless otherwise stated
• Risk in the goods passes to you upon delivery
• If your order arrives damaged, please contact us within 48 hours of receipt with photographic evidence
• We are unable to deliver to PO boxes

5. Nature of Plants & Guarantee

Plants are living organisms and are subject to natural variation. Images on our website are for illustrative purposes only — colour, size, and form may vary between individual specimens and between seasons.

All plants come with a 1-year guarantee. If your plant fails within 12 months of purchase due to a genuine defect or quality issue (and not as a result of incorrect care), we will offer a replacement or full refund.

• We cannot guarantee that a plant will perform identically to the one pictured
• Plants are dispatched in suitable condition for transit; it is normal for some wilting or minor stress to occur during delivery
• Once received, plants must be cared for appropriately; we cannot accept responsibility for plant failure due to incorrect care
• Seasonal availability may affect whether specific varieties are in stock

6. Returns & Refunds

We want you to be completely happy with your purchase. Under the Consumer Contracts Regulations 2013, you have the right to cancel most orders within 14 days of receipt.

• To request a return, contact us at sales@kingsfoldnursery.co.uk within 14 days of delivery
• Plants must be returned in a reasonable condition; we cannot accept returns of plants that have been significantly neglected or damaged
• Return postage is the customer's responsibility unless the item is faulty or incorrect
• Refunds will be processed within 14 days of receiving the returned goods
• We reserve the right to refuse returns where plants show clear signs of misuse or neglect after delivery

If you receive a damaged, incorrect, or dead-on-arrival plant, please contact us within 48 hours with photos and we will arrange a replacement or full refund at no cost to you.

7. Limitation of Liability

To the fullest extent permitted by law, The Garden Works Ltd's (trading as Kingsfold Nursery) liability to you in connection with any order shall not exceed the total price paid for that order. We are not liable for:

• Any indirect, consequential, or special losses
• Loss of profit, revenue, or business opportunity
• Plant failure arising from incorrect care, planting, or environmental conditions after delivery
• Delays or failures caused by circumstances beyond our reasonable control

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

8. Intellectual Property

All content on this website — including text, images, logos, and design — is the property of The Garden Works Ltd (trading as Kingsfold Nursery) or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use any content without our prior written permission.
